📝 Requirements for a Valid DMCA Takedown Notice
If you believe that content available on Nawab Digital Hub infringes your copyright, please send a written notice that includes substantially the following information (as required by 17 U.S.C. § 512(c)(3)):
1. Physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
2. Identification of the copyrighted work claimed to have been infringed (e.g., “My original image titled ‘example.jpg'” or a link to the original work).
3. Identification of the material that is claimed to be infringing and that is to be removed or disabled, and information reasonably sufficient to permit us to locate the material (e.g., the exact URL of the tool or page where the infringing content appears).
4. Your contact information including name, address, telephone number, and email address.
5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
Incomplete or misdirected notices may not receive a response. Please send your notice only to the email address listed above.
⚡ What Happens After We Receive a Valid Notice?
Upon receiving a compliant DMCA takedown notice, we will:
- Immediately remove or disable access to the allegedly infringing material.
- Notify the user who posted or uploaded the content (if identifiable) that we have removed the material.
- Provide the user with an opportunity to submit a counter-notification if they believe the material was removed by mistake or misidentification.
- Terminate repeat infringers in appropriate circumstances (e.g., users who repeatedly upload infringing content).
We take copyright violations seriously. False claims of infringement may result in legal liability, including costs and attorney’s fees. Please ensure your notice is accurate.
🔄 Counter-Notification Procedure
If your content was removed due to a DMCA takedown notice and you believe the removal was a mistake or that you have the right to use the material, you may send a counter-notification. Your counter-notice must include:
1. Your physical or electronic signature.
2. Identification of the material that was removed and the location where it appeared before removal.
3. A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification.
4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court in your judicial district (or in Pakistan if outside the US).
5. A statement that you will accept service of process from the person who provided the original DMCA notice.
Upon receiving a valid counter-notification, we will forward it to the original complainant. If the original complainant does not file a court action within 10-14 business days, we may restore the removed material.
🚫 Repeat Infringer Policy
Nawab Digital Hub maintains a strict policy to terminate, in appropriate circumstances, users or accounts that are deemed to be repeat infringers. We also reserve the right to disable access to any user who violates our copyright policy, even after a single infringement, depending on the severity.
🔍 What Content Does This Apply To?
Our website primarily offers original tools and user-generated content (temporary file uploads via image tools). The DMCA policy applies to any content hosted or displayed on our platform, including but not limited to:
- Any images uploaded via our Image Compressor, Resizer, Cropper, Flipper, or Format Converter tools (temporary processing only).
- Any text or data that may be temporarily processed by our tools.
- Any code snippets or developer resources.
- Any blog comments or user-submitted feedback (if applicable).
Important: Because we do not permanently store user files, we encourage copyright holders to act quickly if they believe their work is being misused through our temporary processing features.
🌐 International Copyright Considerations
While the DMCA is a US law, Nawab Digital Hub respects copyright laws worldwide. Even if you are located outside the United States, you may submit a takedown notice using the same procedure. We will evaluate notices based on the applicable international copyright treaties and respond appropriately.
